ADVICE PROVIDED BY ESG LEGAL
We strongly dispute the Town’s position that they must approve the upcoming PAT application regarding the developers use of public lands. ADC are using this application to comply with condition 42 of their development application.

SDAU HAVE RECOMMENDED APPROVAL FOR MOSMAN HEIGHTS SHOPPING CENTRE - FINAL DECISION THURSDAY 10 AUGUST 2023
The Western Australian Planning Commission (WAPC) today emailed the public the agenda for the upcoming meeting which will make a final decision on the Development Application (DA) for 46 Manning Street (Mosman Heights Shopping Centre). The DA was submitted by Australian Development Capital (ADC) on 21 June 2021.
ADC's Development Application to the SDAU exceeds the height and bulk of the local planning scheme.
These computer-generated image shows the BULK & HEIGHT of the revised plans submitted to the State Development Assessment Unit.
The revised plans were only made available to the public on 3 August 2023. The hearing for the final decision on the Development Application held by the Western Australian Planning Commission will be held on Thursday 11 August 2023.

The Mosman Heights Action Group Inc. is a not-for-profit community group that opposes the inappropriate development of the Neighbourhood Centre (corner of Wellington & Manning St), Mosman Park. Our objective is to bring community members together to support the sustainable development of the Wellington Street Neighbourhood Centre by meeting community needs and expectations. We support development that respects the height and density of the site's R60 zoning.
